(1) If the offender sentenced to imprisonment for one year is not suitable for regular imprisonment considering the offense committed by him, his age, the seriousness of the offence, the manner in which he committed the offense and his conduct, the court shall open him to prison only on the last day of the week or daily at night time only. He can determine the imprisonment to stay.
(2) Notwithstanding anything written in sub-section (1), the punishment under this section shall not be imposed on the offender who commits the offense mentioned in sub-section (3) of section 24.
(3) The court may prescribe the conditions to be followed by the offender while determining the punishment under sub-section (1).
(4) If the offender kept in prison as per sub-section (1) complies with the conditions as per sub-section (3) and pays such period, he shall be deemed to have served such imprisonment while in prison.
(5) If the offender kept in prison according to sub-section (1) does not comply with the conditions of sub-section (3) or if he commits any offense punishable by imprisonment during such period, he shall serve the entire period of his imprisonment in prison.
